1. Acceptance of Terms

Welcome to Hypothex. By accessing or using our website, services, or prediction market platform (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you and Hypothex ("we," "our," or "us"). We reserve the right to modify these Terms at any time. Continued use of the Services after modifications constitutes acceptance of the updated Terms.

2. Service Description

Hypothex is a decentralized prediction market platform built on Hyperliquid's blockchain infrastructure utilizing the HIP-4 protocol. Our Services allow users to:

• Trade outcome contracts based on real-world events
• Create and participate in prediction markets
• Connect Hyperliquid-compatible wallets
• Execute fully collateralized positions on the Hyperliquid blockchain

The platform is currently in development, and the waitlist functionality allows early access registration. Features, functionality, and availability are subject to change.

3. Eligibility

To use our Services, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Not be located in a jurisdiction where prediction markets or cryptocurrency trading is prohibited
• Comply with all applicable laws and regulations in your jurisdiction
• Not be listed on any sanctions lists or prohibited from accessing financial services

By using our Services, you represent and warrant that you meet these eligibility requirements.

4. User Obligations and Conduct

When using our Services, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials and wallet private keys
• Not engage in market manipulation, fraud, or illegal activities
• Not use the Services for money laundering or terrorist financing
• Not attempt to circumvent security measures or disrupt the platform
• Not create multiple accounts to abuse promotions or features
• Comply with all applicable laws, regulations, and these Terms
• Not reverse engineer, decompile, or attempt to extract source code

5. Wallet Connection and Blockchain Transactions

To participate in prediction markets, you must connect a Hyperliquid-compatible wallet. You acknowledge and agree that:

• You are solely responsible for securing your wallet and private keys
• Blockchain transactions are irreversible once confirmed
• We do not custody, control, or have access to your wallet or funds
• Network fees (gas fees) are required for blockchain transactions and are non-refundable
• Transaction confirmation times depend on blockchain network conditions
• We are not responsible for losses due to wallet compromise, private key loss, or user error

6. Trading Risks and Disclaimers

6.1 Financial Risks

Trading on prediction markets involves substantial risk. You acknowledge that:

• You may lose all funds committed to outcome contracts
• Past performance does not guarantee future results
• Market prices can be volatile and unpredictable
• Outcomes may not resolve as anticipated
• You should only trade with funds you can afford to lose

6.2 Not Financial Advice

The Services, information, and materials provided through Hypothex are for informational purposes only and do not constitute financial, investment, legal, or tax advice. You should consult with qualified professionals before making any financial decisions.

6.3 Market Resolution

Market outcomes are resolved based on verifiable real-world events. We use reasonable efforts to ensure accurate and timely resolution, but we do not guarantee the outcome or timing of any market resolution. Disputes regarding market resolution will be handled according to our resolution procedures [to be specified].

7. Fees and Payments

Use of the Hypothex platform may be subject to fees, including but not limited to:

• Trading fees on outcome contracts
• Market creation fees (if applicable)
• Hyperliquid blockchain network fees
• Withdrawal or settlement fees

All fees will be clearly disclosed on the platform. We reserve the right to modify fee structures with notice to users.

8. Intellectual Property

All content, features, functionality, trademarks, service marks, logos, and other intellectual property associated with Hypothex are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. You may not:

• Copy, modify, or create derivative works of our content
• Use our trademarks or branding without permission
• Scrape, data mine, or extract data from the platform
• Frame or mirror any portion of the Services

9. Prohibited Jurisdictions

The Services may not be available in all jurisdictions. You may not access or use the Services if you are located in, or a resident of, a jurisdiction where such use would violate applicable laws or regulations. This includes, but is not limited to:

• Countries subject to comprehensive sanctions (e.g., North Korea, Iran, Syria, Cuba)
• Jurisdictions that prohibit cryptocurrency trading or prediction markets
• Regions where we have specifically restricted access

It is your responsibility to ensure compliance with your local laws.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Guarantees of uninterrupted, secure, or error-free service
• Accuracy, reliability, or completeness of content or data
• Absence of viruses or harmful components

We do not warrant that the Services will meet your requirements or that defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPOTHEX AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Trading losses or losses from market outcomes
• Losses resulting from unauthorized access to your account or wallet
• Losses due to blockchain network failures, smart contract bugs, or protocol vulnerabilities
• Acts of third parties, including hackers or malicious actors

Our total liability to you for all claims arising from your use of the Services shall not exceed the amount of fees you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hypothex and its affiliates, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any rights of third parties

13. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Suspected fraud or illegal activity
• Requests from law enforcement or regulatory authorities
• Technical or security reasons

Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.

14. Dispute Resolution and Governing Law
